1. Applicability

These general terms and conditions apply to all services, offers, agreements, and sessions provided by Sui Cura Coaching and apply to both private clients and natural persons acting in the course of their profession or business (such as sole proprietors or self-employed professionals) who purchase coaching for personal or professional development.

By booking a session or entering into a coaching program, the client agrees to these terms and conditions.

2. Purpose and nature of the services

Sui Cura Coaching provides coaching focused on personal development, emotional regulation, awareness, and strengthening psychological flexibility. The services do not constitute medical treatment, psychotherapy, or specialized mental health care (GGZ). No diagnoses are made and no actions are performed that fall under the Dutch Healthcare Professionals Act (Wet BIG).

Coaching does not replace medical or psychiatric care. In the case of serious psychological complaints or crisis situations, the client is advised to seek appropriate professional help through a general practitioner or specialized care provider. The client remains fully responsible at all times for their own choices, decisions, and results arising from the coaching process.

3. Formation of the agreement

3.1. Intake and individual sessions
An agreement for an intake session or individual coaching session is formed at the moment the client books an appointment and the payment has been successfully completed through the online booking and payment system.

3.2. 12-Session program
If, following the intake session, the client decides to enter into a 12-session program, the agreement is formed after written confirmation by email. By providing this confirmation, the client agrees to these general terms and conditions.

4. Online services

The services are primarily provided online. Sui Cura Coaching is not liable for technical issues on the client’s side, including internet connection problems, equipment malfunctions, or software issues.

5. Appointments, cancellation, and no-show

Appointments may be cancelled or rescheduled free of charge up to 24 hours before the scheduled start time via the online booking system. Cancellations via email, WhatsApp, or other communication methods are not considered valid cancellations. In the event of cancellation within 24 hours or failure to attend (no-show), the full session fee will be charged.

6. Fees and payment

6.1. Intake and individual coaching sessions
Intake sessions and individual coaching sessions must be paid in advance online via the linked booking and payment system. An appointment is confirmed only after successful payment.

6.2. 12-Session program
After written confirmation of the 12-session program, the client will receive an invoice for the agreed program fee. In principle, payment is made prior to the first coaching session. If appropriate within the collaboration, a payment plan may be agreed upon in mutual consultation. The first session will take place after clear agreements have been made.

Refunds of already paid program fees will generally not be granted unless otherwise agreed in writing. In the event of non-payment, Sui Cura Coaching reserves the right to suspend services until the payment obligation has been fulfilled.                                                                                                    

7. Right of withdrawal

If the client, acting as a consumer, purchases a coaching program online, a statutory cooling-off period of 14 days applies. Within this period, the client may dissolve the agreement without stating a reason. If the client requests that the program start within this cooling-off period, the services may commence earlier. In that case, the right of withdrawal lapses once the execution of the program has begun. By agreeing to schedule and start the first session within the cooling-off period, the client explicitly requests the commencement of services and acknowledges that the right of withdrawal expires once coaching has started.

8. Termination of services

Coaching is a voluntary collaboration based on mutual trust, openness, and alignment. Both the client and Sui Cura Coaching may terminate the collaboration, subject to the provisions set out in these general terms and conditions.

8.1. Individual sessions
For intake sessions and individual coaching sessions, the agreement ends automatically after completion of the session, unless the parties decide to schedule further appointments. Paid sessions are not refundable, except where required by law or agreed otherwise in writing.

8.2. Programs
A program, including a 12-session program, is aimed at sustainable personal development and is in principle completed in full unless otherwise agreed in mutual consultation. If the client wishes to terminate the program prematurely, this will first be discussed in a closing session. During this discussion, the parties will jointly evaluate what is appropriate and responsible within the professional collaboration. Refunds of already paid program fees will generally not be granted unless otherwise agreed in writing.

8.3. Interim termination by Sui Cura Coaching
Sui Cura Coaching reserves the right to terminate the provision of services, regardless of the format (individual sessions or program), prematurely. This may be necessary when, according to professional judgment, continuation is no longer appropriate or responsible, or when circumstances arise that hinder a constructive collaboration.

This may include, among other things, a repeated failure to keep appointments, non-payment, boundary-crossing behavior, or request for help that falls outside the scope of coaching. In such cases, where possible, careful consultation will take place regarding an appropriate conclusion of the coaching process or referral.

    9. Intellectual property

    All materials, exercises, and methodologies provided by Sui Cura Coaching remain the intellectual property of Sui Cura Coaching. Reproduction, distribution, or commercial use without written permission is not permitted.

    10. Force majeure

    Sui Cura Coaching is not obliged to fulfill obligations if prevented from doing so due to force majeure, including illness, technical failures, government measures, or other unforeseen circumstances. In the event of force majeure, appointments will be rescheduled in consultation at a suitable time. Previously scheduled sessions will not lapse.

    11. Confidentiality

    All information discussed during the coaching process will be kept confidential. Sui Cura Coaching will not share information with third parties without the client’s explicit consent, unless legally required to do so (e.g., in cases of danger to the client or others).     12. Liability

    The services of Sui Cura Coaching are aimed at personal growth and awareness. The client remains fully responsible at all times for their own choices, actions, decisions, and their consequences.

    Sui Cura Coaching is not liable for direct or indirect damages resulting from decisions made or actions taken by the client during or after the coaching process. If Sui Cura Coaching is nevertheless held liable, liability shall in all cases be limited to the amount charged for the relevant service. Liability for indirect damage, consequential damage, loss of income, or non-material damage is excluded.

    13. Quality and complaints procedure

    Sui Cura Coaching provides its services with professional care and within the scope of coaching as a form of personal development. Services are delivered on the basis of expertise, integrity, and continuous professional development, including further education.

    If a client is dissatisfied with the services, the client is requested to first discuss the matter with the coach so that a suitable solution can be sought jointly. If this does not lead to a satisfactory solution, the client may submit a complaint to an independent complaints body. Sui Cura Coaching is voluntarily affiliated with Klachtenportaal Zorg as an external complaints scheme.

    The complaints procedure of the relevant body applies to the handling of complaints.

    14. Applicable law

    All agreements are governed by Dutch law. Disputes will preferably be resolved in mutual consultation; if necessary, the dispute will be submitted to the competent court.
